This GENERAL CONDITIONS OF SALE govern the sale of Frugone 1885 collections, marketed by Marcopolo S.r.l. - Via G. Bovio 5r, 16145 Genova -  shown in the present website www.frugonecashmere.com

Every visitor of frugonecashmere.com website is required to read the GENERAL CONDITIONS OF SALE carefully before sending any order, once the User submits an order it implies  the full acceptance of all the terms of the present general conditions of sale.

AVAILABILITY OF PRODUCTS

Marcopolo S.r.l. only shows the available products on its website frugonecashmere.com, anyhow it may happen that some items are temporary unavailable or out of stock, when this happens, Marcopolo S.r.l. will immediately update the website and will inform Clients who ordered those items, in order to agree how to modify or cancel  the order.

When Clients submit orders, they accept partial deliveries and renounce to any claim to compensation and/or indemnity related to unavailability of goods

The sending of an order does not implies the acceptance of it by the Seller, in fact the order will only be confirmed when the Seller sends official sale confirmation to the Client.

 

SHIPPING AND DELIVERY

Marcopolo S.r.l. uses the most important express courier, mainly TNT Express, to ship worlwide with special care 

 

SHIPPINGS TO ITALY

Shippings to Italy are free.

Shippings to Italy will be completed within 2 working days from date of full payment received 

Delivery time of the courier in Italy is usually 2/3 working days (1 more for remote areas and islands)

SHIPPINGS TO OTHER COUNTRIES

Shippings to all Countries are free.

Shippings abroad will be completed within 3 working days from date of full payment received.

Deliveries abroad usually take 5/7 days (main Nations).​

Please note that the recipient is responsible for all local custom and import duties.

The Seller will never be responsible for delays on deliveries during particular periods such as sales, holidays or different events such as heartquakes, natural disasters and any other force majeure events out of Seller's control, as well as problems during custom operations or delays of the courier.

 

When the Client receives the parcel, he is strictly required to check the perfect integrity of it and correspondance of number of packages.

if anything wrong, the Client will specify "subject to checks" to the courier and immediately contact the Customer Service at info@frugonecashmere.com

On the contrary, the Client will have no right to contest anything, except what expected in art. 8 regarding the hidden defects.

PRICES AND INVOICING

All the prices in frugonecashmere.com website include VAT.

Prices of each sale are those mentioned in the website at the time of order by the Client.

Prices  can be modified by the Seller and the new prices will be valid from the date of publication on the website.

The changing will not be applied to orders already confirmed by the Seller.

The total due amount of the purchased products must be paid, together with shipping costs when required, when ordering online by credit card or Paypal.

The tax records/receipt will be released by Marcopolo S.r.l. upon delivery

For invoicing, Clients are kindly requested to inform 

- vat number

- name and address

-a phone number for any urgent comunication

The original documents will follow the goods.

CHANGE AND RETURN

Marcopolo S.r.l. guarantees to deliver the products exactly as described and shown in its website frugonecashmere.com.

The images in the website aim to allow the identification of the products by Clients, due to technological reasons they may not resemble exactly the aspect of the delivered product.

The Seller will not be responsible for this.

Anyhow the Client can exercises his RIGH OF WITHDRAWAL, as per Legislative Decree 206/2005 "Consumer Code"

RIGHT OF WITHDRAWAL

as per Legislative Decree 206/2005 "Consumer Code", Clients can change product, size, colour or return the goods as follows:

​

- sending  a registered letter with return receipt or email to the Seller at info@frugonecashmere.com, within 14 days from date of delivery of the goods (re. tracking details of the courier), in order to inform the Seller that the Client intends to exercise the right of withdrawal (art. 52 Consumer Code)

Seller will confirm the receiving of this email comunication to the Client.

- return the rejected goods to the Seller within 14 days from the date of written comunication to the Seller (art. 57 Consumer Code)

The decition of exercising the right of withdrawal must be sent, as above descrived, specifying

- order number, written in the Sale Confirmation sent by the Seller.

- which items Clients decided to substitute or return: we remind to  specify for each item if Client intends to change or to return

in case of change, we remind to specify colour and size of desired item.

Availability of required products will be confirmed by the Seller.

Every returned item must be sent well wrapped in the original packaging safely closed to

MARCOPOLO S.r.l.

together with the original receipt sent by the Seller with the goods.

Without this receipt, Marcopolo will not be able to complete the return procedure.

​

Costs of shipping are at Clients expenses, with terms and process to be complied by Marcopolo S.r.l. , unless personal surrender to the return of what previously specified.

​

Tags and seals of each returned product must be intact,  items should not show any sign of use, no washing, no ironing, no damaging.

Any sign of usage or damaging will stop the return procedure.

​

The Client will be considered liable for any diminished value of the products resulting from all manipulation other than that necessary to establish the nature, characteristics and functioning of the Products.

​

 

RETURN FEES

Clients must choose a safe and trackable way to send the goods back,  Marcopolo S.r.l. will never be responsible for loss, non receipt and/or any damage of the returned goods.

​

Marcopolo S.r.l. can send its courier to collect the return parcel at the address informed by the Client, the cost is euro 10 for service in Italy and euro 20 abroad.

​

The right of withdrawal is faculty of natural persons acting for purposes not directly related to their professional activity, therefore retailers and companies are excluded from this right.

​

REFUND

Once the return is approved, the Seller will refund the due amount through the same method of payment used for the purchase, within 14 days from date of Client's written comunication about decition of exercising right of withdrawal.

Upon approval, the Client will receive an information specifying the amount which will be paid in the coming days.

GOVERNING LAW AND DISPUTES

Any disputes under these General Condition of Sale in frugonecashmere.com website are regulated by italian law.

In the event of any dispute, Court of jurisdiction will be the one based in the town where Clients are residing, otherwise it will be Genova Court.
